Terms of Business For
Permanent Staff And Contract Staff
ACCEPTANCE OF TERMS
1. These are the only terms and conditions of business of JobSearch. The Client Employer, hereafter called the Client, is deemed to have accepted these terms and conditions by virtue of the granting of an interview or the engagement of the applicant introduced by the JobSearch. Engagement shall mean employment or use whether under contract of service or of services including those of JobSearch or a distributor or associated company.
FEES
1. The fee payable to JobSearch by the Client for the introduction of an Applicant is TBC of the Applicant’s basic annual salary.
2. The fee is payable immediately the Applicant is engaged in whatever capacity by the Client, whether now or up to six months following the introduction of the Applicant.
3. Introductions are confidential. The passing on of an introduction to another employer, which results in the engagement of the Applicant, renders the Client liable to JobSearch’s fee as set out in paragraph 2.
4. If any employee of JobSearch is engaged by the Client, JobSearch must be notified immediately by the Client, who must pay an introduction fee in accordance with the scale shown in paragraph 2.
5. Should the Client, or any associated company of the Client, subsequently re-engage the Applicant within six months from the date of termination, a full fee in accordance with paragraph 2 becomes payable.
6. The fact that an Applicant may be personally acquainted with or known to the Client shall be disregarded in any introduction by JobSearch and these terms and conditions shall continue to apply to the engagement as if the Applicant has not been known or acquainted with the Client.
SKILLS & QUALIFICATIONS
1. JobSearch endeavours to make every reasonable effort to ensure the suitability of applicants but JobSearch cannot accept responsibility for any loss, expense, damage or delay, howsoever caused. JobSearch does not personally establish references and the Client is responsible for establishing references concerning the Applicant’s skills, qualifications and integrity. The Client shall ensure such qualifications as are required by law, including work permits and medical requirements.
REBATES
1. JobSearch does not recognise trial periods. In the event of an employee leaving the Client’s employment within eight weeks of commencement, the placement fee will be subject to a rebate as shown below, provided JobSearch receives written notice of the termination within ten working days and provided the invoice has been paid within fourteen days of the invoice date.
Termination up to 4 weeks 50%
Termination between 5 & 8 weeks 25%
The rebate will be in the form of a credit note to be offset against future placements.
Alternatively we will offer to find a replacement candidate free of charge.
PAYMENT TERMS
1. Late payment of an invoice may result in a surcharge being made. This will be calculated from the date of the invoice at a rate of 10% above the prevailing Barclays Bank base rate per month.
2. Should an invoice remain unpaid for 14 days after the due date, the Client shall lose all rights to claim a rebate under the above scheme.
